A large crowd of people packed into the courtroom at the Santa Clara County Superior Court on Thursday as Brian Banks appeared for his preliminary hearing in the case of a woman who disappeared in 1984 and was missing until 2002.

The hearing lasted a grueling five hours.

Banks, 45, faces multiple charges in the case, which includes kidnapping, rape and other charges involving the girl in the rape case.

Rape charges in 2004

Banks admitted to raping the girl and kidnapping her in the 1960s when the girl was a preteen and he was a college student. Banks also pleaded no contest to kidnapping the girl in 1989 while she was 10.

Banks was released from custody in March after spending almost four years in prison, incarcerated at the California Institution for Men in Chino. He was released in part because prosecutors agreed to drop a 1997 kidnapping and rape case against Banks in exchange for his testimony in the disappearance case.

Banks pleaded no contest to the charges in 2004, just a few days before the case was set for trial.

Banks’ lawyer said in court Thursday that Banks never should have been charged in 2004 with multiple sex crimes in the absence of forensic evidence.
